** Submittal Process 2022 **

WHAT is this?

The Town of Rolesville Planning Department is unveiling a new Development Application Submittal and Review process and timelines.  The Town has previously operated a development application review process that is open-submittal and reviews occur on an ASAP basis, with each application being on unique review timelines and sequences.  Depending on the volume and timing of submittals and Staff resources at any one time, this produces highly variable and unpredictable review periods.  Staff seeks to implement these Submittal Date calendars as a means to create a transparent schedule of review from the point of submittal.

WHEN does this take effect?

 January 15th, 2022.  All submittals received between January 15th and February 1st will be Invoiced (payment of fee) and under-go Completeness Check, and be prepared for the first TRC-Staff review cycle (ie February 1) per the calendars.  All submittals received between February 2nd and March 1st will be prepared for the March 1st review cycle; etc.

HOW does this relate to the UDO and LDO?

All new/original Development Applications subject to/reviewed under the Land Development Ordinance (LDO) will follow these Submittal and Review Calendars. The Calendars reflect the processes as required in the LDO. *

Any existing (already under review) applications, either subject to the LDO, or subject to/being reviewed under the Unified Development Ordinance (UDO), will continue to be reviewed on an "open-submittal" basis and reviews occurring under the previous timetable (typical review periods of either 12 or 15 business days, with Comments provided after that).  The intent is to swiftly review and process these applications to their final point of Approval in the same manner as their review lives began. Overall projects that are subject to/being reviewed under the UDO, but have a new/original type of Development Application to submit, will be case-by-case decisions regarding their review timelines.

* Under the UDO, there are unique process steps for certain types of applications, relative to the necessity of Evidentiary Hearings before the Planning Board and/or Town Board. Please refer to the respective Section of the UDO for that application type. Arrange a Pre-Application meeting or contact the Planning Director to discuss the overall process steps.

WHERE do I find Development Application submittal forms, applications, etc. ?

The Forms and Applications webpage - https://www.rolesvillenc.gov/planning/forms-and-applications - contains the current documents.  The respective sections of the UDO and LDO (and the LDO's Appendix A, Handbook) contain further details about minimum submittal requirement when designing/creating various plan sets, etc. For example, UDO Sec. 15 include details on the various required elements and information for subdivision plats. 

NOTE - The existing forms may be revised at any time, and new forms, application, and submittal checklists will be created and required in the near future. Please bookmark the main page, but not individual linked items, as those links are likely to change.  Please visit this page each and every time you go about creating a new application to ensure you are utilizing the latest/new documents.  Completeness Check review will also work to ensure applications are utilizing/contain the most current or new documents. 

HOW will Comments be provided to Applicants?

A comprehensive set of organized Staff Comments will be posted to a/the overall projects webpage here on or by the 'Comments Provided' date in the Calendars.  Applicants will NOT be notified otherwise that the Comments have been posted; it is the responsibility of each Applicant to visit the webpage, and download the Comments. NOTE: Any late publications of comments will be shared with that Applicant case-by-case, and accommodations made accordingly.   

HOW will 'TRC Meetings' be utilized and function under this new process?

Per each Calendar and each review cycle, a (at this point in time, virtual via ZOOM/TEAMS) TRC Meeting Date (2nd Thursdays) is provided, and that meeting will be organized with time slots for each Application.  An invitation to this meeting will be provided to all Applicants of Record for the applications in the review cycle.  Confirmation of attendance will be requested so as to most efficiently operate this online meeting for all parties attending. 

NOTE - attendance is at the discretion of the Applicant. It is not compulsory. This is a service provided by the Town to facilitate an environment to discuss Comments with Staff.

Off-line meetings, etc. between Applicant and individual Staff reviewers is permitted and encouraged, but No Approvals can result, and all revised materials must be submitted per these processes. 

How does Submittals & Review relate to the posted Planning Board/Town Board dates?

For applications requiring Planning Board or Town Board action, TRC-Staff approval must first be achieved before moving forward in the schedule to the PB/TB meeting.

After the TRC meeting, if there were review comments that require revisions and a re-submittal, the Applicant shall re-submit by / before the next Submittal date (of their choice), and the review cycle will repeat.

As per the current review cycle method, cycles of submittals/re-submittals and reviews will occur until there are no remaining TRC Staff Comments, and each of those entities provides “Approval” of the application.

Disclaimers

Placement (of an Application) on a particular Planning/Town Board Agenda is ultimately at the discretion of the Planning Director, as there could be unforeseen circumstances regarding the forwarding of any particular Application to that meeting date.  These will be case-by-case circumstances broached with each Applicant at the point of TRC-Staff final approval of that application, if not earlier/as identified. 

Modifications to or deviations from these Calendars shall be at the discretion of the Planning Director.

Please Note – at this time these Calendars are implementing a one-time-per-month Submittal Date and review cycle. Additional submittal dates and associated review cycles, including those exclusively for re-submittals, may be implemented in the future as Staff capabilities allow and an efficient, timely, and predictable review process can be provided to all Applicants.

If an application has Comments requiring revisions and a resubmittal and formal review by TRC Staff, Applicant shall re-submit by/on the next Submittal Date and repeat the process on that Submittal cycle.

For example, an application on the March 1st Submittal cycle that requires re-submittal after its April 14th TRC meeting, would resubmit by/on May 2nd. Should TRC approve the application, it would move forward to the June 27th PB Meeting and then proceed to the August 2nd TB Meeting.  Thus, an application requiring 2 review cycles begins on March 1st and reaches the TB on August 2nd (approximately 5 months or 22 weeks after beginning the formal review and approval process).

If an application has Comments requiring revisions and a resubmittal and formal review by TRC Staff, Applicant shall re-submit by/on the next Submittal Date and repeat the process on that Submittal cycle. For instance, an application on the March 1st Submittal cycle that requires re-submittal after its April 14th TRC meeting, would resubmit by/on May 2nd.  Thus, an application requiring 2 review cycles begins on March 1st and - assuming no further comments are provided/all reviewers grant Approval – the application would be approved on June 6th (approximately 14 weeks after beginning the formal review and approval process). 

Please note, when possible by the TRC Coordinator on a case-by-case basis, Approval can be granted before the ‘Comments Provided’ date of each review cycle, thereby reducing the actual amount of review time.
