MA 19-05 (Approved 10-01-2019 by Town Board of Commissioners)

A Map Amendment request by property owners Lynda Ruiz-Orta and Benjamin Orta to rezone 515 S Main St. from the Residential 1 (R-1) District to the Commercial Outlying - Conditional Zone (CO-CZ) under the Unified Development Ordinance (UDO). - Neighborhood Meeting held August 22, 2019.

- Planning Board meeting held August 26, 2019 - unanimously Recommended Approval to the Town Board.

- Town Board meeting held October 1, 2019.  The Town Board unanimously Approved the Map Amendment request subject to the presented Conditions of Approval.

 SUP 22-02- (Approved 12-13-2022 by BOA)

A Special Use Permit application to request to undertake the Zoning Use of 'single family detached residential' aka "Dwelling - Single family" at the property; the use of "Dwelling-Single family" is listed as an allowed 'special use' per the Conditions of Approval associated with MA 19-05 which rezoned the property in 2019 (with conditions).  

- Board of Adjustment meeting held December 13, 2022- an Evidentiary Quasi-judicial hearing was conducted, and the Board unanimously Approved the Special Use Permit Request with a Condition of Approval for no longer than thirty-six (36) months. The Special Use Permit takes effect December 13, 2022 and expires on December 13, 2025.

Special Use Permit (SUP) 22-02 was presented to the Board of Adjustment on Tuesday, December 13, 2022. The Board unanimously approved the request. SUP 22-02 was recorded on February 16, 2023 with the Register of Deeds and can be found under Book of Maps: 019262 Pages: 00991-00994

Special Use Permit SUP 22-02 is being prepared for presentation to the Board of Adjustment (BOA) on December 13, 2022 for an Evidentiary Quasi-judicial hearing and action.  

MA 19-05 Approved

October 2, 2019

The Town Board unanimously approved MA 19-01 at a public hearing on October 1st. This action changed the zoning of 515 S Main St. from R-1 to CO-CZ.

The Town Board will hold a public hearing for MA 19-05 on October 1, 2019 at 7:00 p.m. The meeting will be in the Town Board room and is open to the public.

Planning Board Recommendation

August 27, 2019

On August 26, 2019, the Planning Board voted to favorably recommend MA 19-05 to the Town Board of Commissioners. The date of the Town Board hearing is forthcoming.

The neighborhood meeting for 515 S Main St. will be August 22, 2019 at 6:30 p.m. at Rolesville's Community Center, 514 Southtown Cir. This meeting is open to the public.
