Merritt Property - compilation of THREE properties ( 1768236815; a 37.367 acre portion of 1758928330; a 12.996 acre portion of 1768328863 ) totalling 148.603 acres for development of a maximum of 525 single family residential dwelling units and ___ acres of non-residential uses.   Property Ownership is seven (7) separate entities, being: 1) Betty R. Gunz; 2) Liles Family LLC; 3) Wesley/Roxey Wilkins; 4) James/Sue Merritt; 5) Williams Rogers c/o TexWest, LLC; 6) William Merritt & Kathy Llamas; 7) Samantha Self Hiatt. 

TA-24-01 - APPROVED 2024-08-06 - Text Amendment to amend the LDO Zoning District 'Residential High (RH)' Table 3.1.3. Residential High Development Standards and Table 6.4.3.G. Off-Street Parking Requirements. On June 24, 2024, the Planning Board recommended Approval to the Town Board. On August 06, 2024, the  Town Board of Commissioners voted 3-0 (2 absent) to Approve. 

ANX-24-02 - APPROVED 2024-11-07 - Voluntary Annexation petition submittal, to voluntarily annex 148.529 acres, comprising of 3 properties (portions there of) currently in the Town's Extraterritorial Jurisdiction (ETJ) into the corporate limits of the Town.  The properties are detailed as:

  1.  PIN 1768328863, addressed as 1224 Rolesville Road, property is 18.02 acres / acreage to be annexed is 12.996 acres. Petitions for GUNZ and ROGERS submitted for this property.
  2. PIN 1768236815, addressed as 6200 Emily Lane, property is 98.166 acres / entire 98.166 acre tract proposed for annexation. Petitions for SELF, WILKINS, MERRITT and MERRITT are submitted for this property.
  3. PIN 1758928330, addressed as 0 Louisburg Road, property is 79.28 acres / acreage to be annexed is 37.367.  Petition for LILES LLC submitted for this property.
  • 1st Submittal received 03-02-2024, on review by TRC-STAFF during MARCH, comments to be published by/or 04/8/2024.
  • 2nd Submittal received 06-28-2024 - preparations for Legislative Hearing underway.
  • Call for Town Clerk to Investigate Sufficiency occured on 2024-08-06.
  • Call for a Legislative Hearing (to be held 2024-09-17) occured on 2024-08-06.
  • 2024-09-17 - A Legislative Hearing was opened for consideration of the Voluntary Annexation Petition. The Hearing was continued.
  • 2024-11-07 - The Board of Commissioners concluded the Legislative Hearing, and voted unanimously (5-0) on a Motion to Approve.

     

REZ-24-01 - APPROVED 2024-11-07  - Rezoning application to request Rezoning of 148.529 acres, being 1768236815, (portion of) 1768328863, and (portion of) 1758928330, from the Town LDO Residential Low (RL) District to the Residential High (RH), as a Conditional Zoning (CZ) District, subject to a set of proposed Conditions of Approval and a Sketch Concept Plan.  The TRC Staff reviewed X submittals between February and July 2024.  The Applicant conducted the required Neighborhood Meeting on 2024-07-10. On 2024-08-26 the Planning Board made a Recommendation of Approval to the Town Board of Commissioners by a vote of 4-1-1-1 (4 for, 1 against, 1 absence, 1 recusal).  On 2024-09-03 - New/revised Property Legal Descriptions for the 2 General Commercial (GC) Districts.  On 2024-09-10 -  New/revised Applications for Gunz, Liles, Rogers (TexWest LLC) properties, and Rezoning Survey exhibit that states Proposed RH-CZ District to be 143.097 acres, and Proposed GC-CZ Districts to be 5.189 ac. and 3.992 ac. (Totaling 9.181 ac.).  On 2024-09-17 - The Board of Commissioners opened a Legislative Hearing for consideration of the Rezoning Map Amendment application. The Hearing was continued.  On 2024-11-07 - The Board of Commissioners concluded the Legislative Hearing, and voted unanimously (5-0) on a Motion to Approve.

FSP-25-24 - RECORDED 2025-12-04 as BM2025/Pg2321 aka Doc#2025093804 - Betty Gunz/TexWest LLC - Plat to dedicate Right-of-way for Fowler Road and Street Buffer.   Three (3) submittals reviewed by TRC STAFF between SEPTEMBER and December 2025. Approved for Recordation 2025-12-03.


PSP-24-07 - APPROVED 2025-12-03 - Preliminary Subdivision Plat to subdivide 3 Tracts - PIN's 1768236815 (XX ac.), 1768328863 (XX ac. portion), and 1758928330 (XX ac. portion) - totalling 152.278 acres to create 225 Single-family Detached (SFD) and 274 Single-family Attached (SFA, or Townhome) lots, XX Open Space lots, XX non-residential Lots, and XXX Linear Feet of XX' wide Right-of-way / XXX Linear Feet of XX' wide Right-of-way /XXX Linear Feet of XX' wide Right-of-way.  This subdivision is pursuant the Board of Commissioner's approvals of ANX-24-02 and REZ-24-01 on 11-07-2024. Four (4) Submittals reviewed by TRC Staff - 1st submittal 40 plan sheets during DECEMBER 2024 with comments published on 2025-01-06; 2nd Submittal 42 plan sheets during FEBRUARY 2025 with comments published on 2025-03-09; 3rd Submittal 46 plan sheets during APRIL 2025 with comments published on 2025-05-04;  4th Submittal XX Plan sheets received 2025-11-21, reviewed ASAP with comments (Approval) published on 2025-12-03.

November 7, 2024

On November 7, 2024, the Board of Commissioners concluded a Legislative hearing for Rezoning application REZ-24-01, and Voluntary Annexation Petition ANX-24-02. The Board voted unanimously (5-0) on Motions to Approve both the Rezoning and Voluntary Annexation petition.
